Online dispute resolution for consumers
The consumer residing in Europe must be aware of the fact that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve by non-judicial any dispute relating to and / or arising from contracts of sale of goods and services entered into the network. Therefore, if you are a European consumer, you can use this platform for the resolution of any dispute rising from the online contract with the owner. Payments
To ensure the best safety during payments our site we use the Paypal platform leader for the management of online payments, with this service you can pay through Paypal circuit or, alternatively, using a credit card. We would like to clarify that in no way our systems store sensitive data on your credit card. Alternatively you can make a payment by bank transfer. In this case you will receive an email with all the data necessary to carry out the operation, to which please reply with an email of payment, necessary to speed up the verification process.
Guarantees
All products of Simoni Racing catalog respect the Italian manufacturer's warranty (Legislative Decree 24 of 02/02/2002). In order to benefit from it guarantee just keep the invoice, packaging intact and the products ordered. To obtain warranty service, products must be used correctly, respecting its intended use and as provided in the technical documentation attached to them. If, as a result of technical intervention by Simoni Racing, the defect is not covered by the manufacturer's standard warranty, the customer will be charged for any costs of verification and recovery, as well as transportation costs, if incurred by Simoni Racing.
Returns / Returns Policy
The law (Legislative Decree no. 206 of 06 September 2005 cd. consumer code) guarantees the right to withdraw, for whatever reason, the purchase contract; this right is reserved for natural persons, thereby excluding purchases made on behalf of a company, or any purchase made by indicating in the order form Simoni Racing Spa a VAT number reference.To take advantage of the the right of withdrawal, it is necessary to fill in the appropriate form (download here) or send communication to: Simoni Racing Spa Corso Italia 500, 44047 Terre del Reno Loc. Mirabello (FE), within 14 working days from the date of receipt of the goods; or send a fax (at n. 0039532849818) or an email (simoni@simoniracing.it) in which to express the intention to withdraw from purchase.
The right of withdrawal is subject to the following conditions:
• The law applies to product purchased in its entirety; it is not possible to exercise withdrawal only of part of the purchased product (ex .: accessories, attachments, etc. ...);
• The products must be returned intact and in original packaging, complete in all its parts (including any documentation and accessories: manuals, cables, etc ...);
• The products must be returned with the original receipt
• Shipping costs are charged to the customer
• The shipment is under the customer's responsibility up to the certification of receipt of goods to the headquarters Simoni Racing Spa; therefore it is recommended that an insured shipment with receipt of delivery to the recipient;
• the customer will monitor the shipment with the courier and check for irregular status of the delivery; Simoni Racing Spa is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
• Simoni Racing once received the returned goods, examine the product to assess any damage or tampering not caused by transport. If the original packaging inside/outside is ruined*, Simoni Racing Spa will deduct from the refund due a minimum percentage as contribution for the cost of restoring the goods.
The flat rate for each returned item is available in the following table:

Without prejudice to any repair costs for damage to the original packaging and / or storage costs, Simoni Racing Spa will replace the purchased goods or to refund the full amount paid (excluding credit charges) within 14 days from the date of receipt of goods.
According to article 56 of the Consumer Code, the refund will be made "using the same mean of payment used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise, and on condition that he does not have to bear any costs as a consequence of the refund.
The right of withdrawal is lost for lack of the essential integrity of the property (packaging and / or its contents), in cases where Simoni Racing Spa finds:
• the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
• damage to the product for reasons other than transportation. If decay the right of withdrawal, Simoni Racing Spa will return to sender the product purchased charging the shipping costs.
*= we kindly ask our customers to carefully open the packages, avoiding completely destroying the packaging, in the case of blister packs, for example, we invite you to make a side opening.
Limitations of liability
The information on this web site have been carefully reviewed and published by professionals. Simoni Racing SpA, nor its affiliates shall be liable for delays, lost profits, direct, indirect, special or incidental damages that result from any inaccuracies or omissions in this catalog, even if advised of the possibility of such damages. The design and the material of the marketed products may be subject to change without prior notice, the photos are not contractual.
For damage exclusion
Simoni Racing will not be responsible for any accident and / or damage incurred subsequent to the sale and will not compensate any costs except those of the product itself.
Products and their use
The approved items are indicated with APPROVED / I marked and can be used on roads open to traffic. Articles are NOT APPROVED for use in closed circuits or in fairs, events.
Simoni Racing will not be held responsible for damage caused by incorrect installation of the products. We recommend the installation of the articles in these pages, by trained personnel.
For every order placed SIMONI RACING invoices of material sent by e-mail to the order. The data provided by you when you order will be included in the invoice. No change will be possible after the issuance of the invoice. It will therefore not be possible to send goods by private buyers who do not provide their social security number.
The customer can buy products in the electronic catalog SIMONI RACING, when the order. The images and technical data in support of a product may not be complete and comprehensive of its characteristics but different for example: (weight, color etc ...).
Shipments
The word "available" when the displayed product is indicative, it is possible to 'multiple purchase at the same time by multiple users. Therefore Simoni Racing Spa reserves the right, once received the order, to check and promptly notify the non-availability of the product.
If the items are in stock:
3-5 days for shipments to Italy / 7-12 days for other countries
If they are not in stock: 30 Days
Some imported products may be postponed for further 15-20 days delivery time indicated.
Delivery times are to be considered purely indicative .Simoni Racing Spa will not be responsible for the delay in fulfilling its obligations (including delivery or service) if the delay is caused by circumstances beyond its reasonable control and will be entitled eligible for an 'extension of time for non-performance. If the event of force majeure persists for a period longer than two months either party shall be entitled to withdraw from the contract without any compensation being due to the counterparty.
Simoni Racing will be considered also not responsible for any changes in costs, because beyond its control.
The express carriers for shipments to Italy are BRT and GLS.

Simoni Racing S.p.A. You can only accept orders for delivery in Italian territory, San Marino and Vatican City.

The delivery of goods shall be deemed to street level (do not deliver the plans in any case)
Upon delivery of the goods by the courier, the customer is required to check:
• that the number of packages is as specified in the accompanying document
• The packaging is not damaged or wet or altered, including the packaging materials such as adhesive tape or strapping.
• Any damage to the packaging and / or product or the mismatch in the number of packages or particulars, must be immediately notified, subject to control by writing (specifying WITH EXTREME PRECISION THE SAME REASON THE RESERVE, eg. "Packaging broken" , "wet pack", etc.) on the proof of delivery courier.
Once signed the document courier, the customer can not make any objection about the appearance of what was received.
Any problems concerning the physical, the mismatch or incompleteness of the products delivered, must be reported within 3 days of delivery, as specified in this agreement.
You can not choose specific day and time, it is however possible to directly contact the carrier indicated in the e-mail or shipment confirmation SMS.
If you are unable to make delivery to the absence of the recipient, the address indicated, the courier will leave a notice (also receive e-mail or text message), then make a second attempt and, if again, the absence of the recipient , leave a second notice of passage. After two attempts to vacuum delivery, the package will remain in doposito at the courier for 5 days, from the date of the second notice. After that time, the material in storage at the warehouses of the courier (because of repeated inability to deliver to the address specified by the Customer), the goods will be made to return at our office.
If the 'delivery address provided by the Customer is incorrect or if it is rejected delivery, the goods will return to the sender and the order will not be sent back a second time to the customer.
It is in no way possible to vary the times and the delivery lugo once the shipping documents issued.
